aight so if you dont know about this case its fucked up. some 16 yo kid was in some type of gang shooting and a stray bullet hit a ten year old little girl and killed her. shit is fucking sad
ALBANY, N.Y. -- "I would hope that every single person within earshot who has any information about this case as well as other people and other crimes in communities, step forward and always be honest with law enforcement," said Albany County District Attorney David Soares Tuesday. But that hasn't happened in the trial of Jermayne Timmons. Key witnesses have repeatedly changed their stories - even admitting to lying on the stand. "The prosecution's case is not over. This is an experienced prosecutor who's trying this case," said Soares. Earlier this week one witness told the courtroom he gave police a statement he swore to be true. The witness said he was only in the First Street area where Kathina Thomas was shot to buy cell phone minutes. But it was a lie. He later said he was really riding his bike with Timmons and another witness, looking to start trouble. "It's a bit surprising that the case starts out with a witness on a material issue who admits lying to the jury," said legal expert Paul Der Ohannesian. "That's not a good start for the prosecution." Then, more lies. The same witness told the courtroom they started trouble because another witness had been shot. After further questioning, he admitted that person had actually shot himself in the foot. When that witness took the stand, at first he lied about that incident. Then he said his father pressured him to give a statement to the police, hinting he lied again. "Crimes conceived in hell don't have angels as witnesses," said Der Ohannesian. He said attorneys can't have someone testify if they know they'll lie. And yet, some witnesses are doing just that, apparently fearing retribution. "These are individuals we take as we can get them. If the jury is prepared for that, it can make it easier to accept," Der Ohannesian said. He adds that lying on the stand is certainly nothing new - just something the jury will have to deal with. "Organized crime has had a no-snitching policy for a long time. That hasn't stopped prosecutors from effectively prosecuting organized crime cases," he said. "This case isn't going to be a reflection of this office," Soares told reporters. "It's a reflection on this community, and how this community wants to define itself." Leaving jurors to sort through all the lies. We have reached out the DA's office to see if they will be pursuing perjury charges against any of the witnesses who have admitted to lying in this case. A spokeswoman tells us they are solely focused on prosecuting Jermayne Timmons, but wouldn't rule it out. |
